Comment by Elżbieta Delert-Wiącek on responsibility for the payment of royalties by CDA for WP Finanse

According to the ruling of the Poznań District Court, CDA, the company responsible for the video content platform, must provide detailed information about the content published on the platform between 2013 and 2022. Among the information required are details about the works shared, the IP addresses of computers from which files were uploaded, and the number of plays of the content posted. The court’s decision follows a case in which ZAIKS sought to obtain payment for author royalties from CDA.

Our expert emphasizes: “The responsibility for the payment of royalties lies with CDA, and the ruling cannot serve as a basis for holding users accountable. However, identifying cases where copyright violations may have occurred could prompt ZAIKS to take legal action against users who publish illegal content.”
