Some employees prefer shorter, more frequent breaks instead of a single two-week-long holiday. While this method of planning leave may be attractive to employees, it raises certain concerns for employers.
In the latest article for Prawo.pl, Ewelina Miłobędzka, a Legal Advisor in the Labour Law Department at Sadkowski and Partners, comments on this issue.
Our expert advises employers to exercise caution: “Although the Labour Code does not explicitly provide for direct sanctions for this specific violation, dividing the 14-day holiday (except in certain cases) can be problematic. I have frequently encountered instances where such practices have been challenged by the National Labour Inspectorate in post-inspection reports. It is acknowledged that some employers, in accommodating employees, protect themselves by obtaining statements from them, indicating that the division of the leave was at their explicit request.”
