The Social Insurance Institution (ZUS) is issuing hundreds of decisions concerning entities that no longer exist. These cases end up in common courts, which can only amend the contested decision or rule on the merits of the case. However, the court does not have the authority to annul the decision and refer it back for reconsideration when it involves a contribution payer. Legal experts emphasize that legislative changes are needed to prevent ZUS from bypassing administrative procedures.
Karolina Rzepecka, an attorney in the Labour Law Department at Sadkowski and Partners, commented on this issue in an article for Prawo.pl.
According to our expert, during the administrative proceedings, pension authorities often fail to verify whether the entity in question has changed its name or still exists—despite being obligated to consult publicly available registers such as KRS or CEIDG, where this information is readily accessible.
