MRPiPS proposes that employers with up to 50 employees develop notices outlining policies, including those regarding the prevention of mobbing. However, before issuing them, they must consult the content with trade unions, or in the absence of such unions, with employee representatives.

But beware! These are yet another set of regulations that would impose an obligation on employers to enter into agreements or conduct consultations!

In an article for Prawo.pl, Marcin Frąckowiak – Managing Counsel and Legal Advisor in the Labor Law Department at Sadkowski and Partners – shares his commentary.

According to our expert, this is an effort to force dialogue in a situation where a culture of communication with staff has not developed in Poland. In the case of small and micro enterprises, such consultations will be fictitious. This is a consequence of the fact that trade unions are not a popular form of association in Poland.
