The amendment to the Public Holidays Act proposes Christmas Eve as a day off, while also establishing an additional trading Sunday before the holidays. The law, signed by the President, has been referred to the Constitutional Tribunal for subsequent review. Could the amendment be deemed unconstitutional due to potential discrimination against retail workers?
In an article for Rzeczpospolita, Marcin Frąckowiak – Managing Counsel and Attorney-at-law in the Labor Law Department at Sadkowski and Partners – commented on this issue. In his view, different sectors of the economy serve different functions, and it is impossible to compare retail workers with individuals employed in public administration or uniformed services. He also emphasizes that determining whether the principle of equality is being respected must be assessed within the specific group performing a particular type of work.
