Marcin Frąckowiak’s Comment on the Amendment to the Labor Code for Prawo.pl

The Sejm has supported an amendment to the Labor Code, aimed at increasing penalties for employers who commit offenses against employees’ rights. This includes situations where civil law contracts are used in circumstances where an employment contract would be appropriate.

In an article for Prawo.pl, Marcin Frąckowiak, Managing Counsel and Attorney-at-law in the Labor Law Department at Sadkowski and Partners, provided his comments on the matter.

According to our expert, the increase in penalties should be preceded by research showing how often the maximum penalties are currently imposed.

“From my experience, the current maximum penalty of PLN 30,000 is imposed relatively rarely. This is very poor PR for the change. While a more aware employer, who has legal support, can fight in court to defend themselves against the maximum penalty, for a small entrepreneur, this is money they might not see even in an entire year. So, they may think: why should I hire an employee on an employment contract, only to risk a penalty of such a high amount?” emphasizes Marcin Frąckowiak.
