New obligations for companies and institutions working with children and youth!

03.04.2025 / News / Family Law

As of January 2025, intensified inspections have begun for entities that offer services not only to adults but also to children and adolescents. This is due to the amendment of the Family and Guardianship Code, commonly referred to as the “Kamilek Act”, which imposes a number of new obligations on companies and institutions aimed at better protecting minors.

Who is affected by the changes?
The obligation to implement the new regulations applies to care and educational facilities, as well as organizers of extracurricular activities, workshops, recreational, educational, sports, and even medical programs.

What documents are required?

➡ Child Protection Policy / Standards
➡ Safe recruitment procedures for staff
➡ Guidelines on safe staff–child interactions
➡ Facility regulations
➡ Monitoring report of the Policy / Standards
➡ Declarations from parents (e.g. consent for image use / participation in activities)
➡ Information on available support services
➡ Survey monitoring the implementation of standards

Failure to implement the required documentation may result in criminal liability for members of the management board!
