In the August issue of the Real Estate Law Newsletter, we inform you about:

  • Regulation of the Minister of Development and Technology dated July 15, 2024, concerning the method of determining requirements for new developments and land use in the absence of a local spatial development plan, came into force.
  • The first reading of the parliamentary bill amending the Civil Law Transactions Tax Act, also known as the “anti-flipping” law, took place. The bill aims to amend the Act of September 6, 2000, on Civil Law Transactions Tax, by introducing additional tax rates for the sale of residential properties within a short period after purchase.
  • The approval of the Chopin Airport Master Plan by the Minister of Infrastructure has resulted in changes to the area previously covered by the master plan. This poses challenges, particularly for properties located in Warsaw, where local spatial development plans have not been adopted. Consequently, a parliamentary proposal for an amendment to the Aviation Law has been submitted to the Sejm.

In the latest issue, an expert reminder was provided by Barbara Hornowska from our law firm’s Real Estate Law Team. Our expert highlights that perpetual usufruct holders have only until August 31, 2024, to request the sale of the property in their favor.
