The State Is Fighting “Junk Contracts”. Will It Start with Itself?

As of 8 July 2026, the National Labour Inspectorate (PIP) has gained new powers allowing it to more effectively challenge cases where employment contracts are replaced with civil law contracts. Meanwhile, according to a publication by Prawo.pl, the public administration sector continues to make extensive use of mandate contracts (umowy zlecenia).

Marcin Frąckowiak, Managing Counsel and Attorney-at-Law in the Labour Law Department at Sadkowski and Partners, commented on this issue in an article published by Prawo.pl. Our expert highlights the need to apply equal standards to all employers:

“When I hear about the large scale of civil law contracts being used in public administration, I wonder whether this does not constitute an abuse. After all, recent months have shown that the Ministry of Family, Labour and Social Policy is seeking to make employment contracts the standard form of employment. Private employers are being encouraged to review their contracts and convert them into employment agreements. This raises the question: why do we not encourage public offices to do the same?”
