Victory in a Defamation Case
On 19 December 2025, a final and binding judgment was issued acquitting our Client, who had been charged under Article 212 § 1 of the Polish Criminal Code.
The case originated from a civil dispute. During the proceedings, statements made by our Client were challenged, which subsequently led to a private prosecution being filed against her on allegations of defamation, raised in the context of parallel family law proceedings.
The Court fully accepted the defence’s arguments, concluding that the Client’s conduct did not meet the statutory elements of the offence. A consistently implemented litigation strategy ultimately led to her acquittal.
This outcome highlights the importance of a coherent defence strategy and the active involvement of defence counsel at every stage of criminal proceedings.
In our practice, we frequently handle cases initiated by private prosecutions—often forming part of broader disputes between the parties. However, these remain criminal proceedings that may result in a conviction and can have a tangible impact on the accused’s reputation.
For this reason, such cases should not be underestimated—properly prepared strategy and professional defence are crucial.
